The videos contained/displayed in the App may contain personal recollections of the persons publishing such videos or of persons featured in such videos. Such persons may have tried to describe events, locales and conversations from their personal memories, and as such may not be entirely accurate or true. itihaasa shall not be liable or responsible in any manner for any inaccuracies, discrepancies or errors with respect to persons, dates, places or events in the videos contained/displayed in the App.

Privacy Policy

I.  Background

1.1.  itihaasa Research and Digital (the “Organization”) adheres strictly to data privacy laws in India and in order to ensure compliance with the same, the Organization has established this privacy policy which shall be amended as and when required by the Organization (the “Privacy Policy”). The Organization, understands the importance of data security, and prioritises protection of personal data. This Privacy Policy envisages and explains the manner in which data is collected and the manner in which it is used in relation to the smart phone application named as “itihaasa” (the “App”) and the website www.itihaasa.com (the “Website”) operated by the Organization. Please note that the Website and the App are for the information and benefit of people in India.

1.2.  Please read the Privacy Policy carefully before using or registering on the App or the Website or accessing any material or information through the App or Website. By clicking on the “I accept”/ “Continue” button provided below, you accept this Privacy Policy and agree to be legally bound by the same.

II. Information collected

This Privacy Policy applies to information that:

2.1.  You may provide to us voluntarily while registering on our Website and/or App, such as name, email address, passwords, contact number, reviews and feedback, etc. All Information disclosed by you shall be deemed to be disclosed willingly and without any coercion. No liability pertaining to the authenticity/ genuineness/ misrepresentation/ fraud/ negligence, etc. of the Information disclosed shall lie on the Organization nor will the Organization in any way be responsible to verify any Information obtained from you.

2.2.  We may collect Information automatically from you when you access or use our Website and/or App. For example, we may automatically collect your location, computer operating system, Internet Protocol (IP) address, Information about your internet connection and mobile device, access times and the browser type and language. Further, we may collect Information about your preferences and settings such as time zone and language, your searches and the results you selected from the search and your browsing information. We also collect Information about your usage and activity on our Website and/or App using certain technologies, such as: cookies. Cookies are small data files that may have unique identifiers and reside, among other places, on your computer or mobile device, in emails we send to you, and on our Website and/or App. Among other things, cookies help us improve our Website and/or App, and your experience.

2.3.  Web Beacons: We may collect your Information using web beacons. Web beacons are electronic images that may be used on our Website and/or App or in our emails. We use web beacons to deliver cookies, count visits, understand usage and campaign effectiveness, and tell whether you open an email and act upon it.

2.4.  This Privacy Policy envelops two broad categories of Information, namely, personally identifiable information or personal data (the “PII”) and the non-personally identifiable information (the “NPII”). PII shall also include a sub-category of information known as sensitive personal data or sensitive personally identifiable information (“the “SPII”). PII essentially includes, but is not limited to, Information which can be used to directly or indirectly to identify you such as your name, email addresses, contact details, and your login details. SPII includes but is not limited to information such as passwords. SPII also includes your credit card information and other payment information, which may already exist on the Apple App store or Google Play Store, and which may be disclosed to the Organization at the time of your installation, use or access of the App or the Website. NPII includes, but is not limited to, your IP address, cookies, third party’s cookies and web pages that have been viewed by you on the App or the Website. In the case of use of cookies or third party’s cookies, if you prefer, you can usually choose to set your browser to remove or reject cookies. PII, SPII, and NPII shall hereinafter be jointly referred to as the “Information”. In order to register on the App or the Website, we will collect your PII and SPII.

III.  Consent

3.1.  By accepting the terms of this Privacy Policy, you expressly consent to the Organization’s collection, use and disclosure of your Information in the manner prescribed in this Privacy Policy. In the event that you wish to withdraw your consent to such use and disclosure of your Information, you must contact the Organization at privacy@itihaasa.com, informing the Organization of your withdrawal of consent of the Privacy Policy. Please note that in the case you withdraw your consent to use and disclosure provided by the Privacy Policy, the Organization reserves the right to not to permit access to the App or the Website.

3.2.  We reserve the unconditional right to change, modify, add, or remove portions of this Privacy Policy at any time, without specifically notifying you of such changes. Any changes or updates will be effective immediately. You should review this Privacy Policy regularly for changes. You can determine if changes have been made by checking the “Last Revised” legend. Your acceptance of the amended Privacy Policy shall signify your consent to such changes and agreement to be legally bound by the same.

3.3.  You represent that you are of legal age to form a binding contract and are not a person barred from using the Website and/or the App under this Privacy Policy or under the applicable laws. Our Website and App is not directed for the use of children below the age of 13 (thirteen) years.

IV. Purpose and use of collecting Information

4.1.  The Organization undertakes that it shall not provide, distribute, trade, sell or rent your Information provided on the App and/or the Website or related to past use of the App or the Website to any third party, except as provided in this Privacy Policy herein or through any other instruction issued by the Organization.

4.2.  It is important that you understand that the Organization assembles all your Information as a whole and uses it in aggregate form. The Organization shall not divulge any of your Information unless expected by it under applicable law or in the manner envisaged in this Privacy Policy. The Organization uses your Information in an aggregate, de-identified form, in order to determine ways in which it can create an improved overall experience for you. The Organization shares your Information with its affiliates and its collaborators but only in in an aggregate, de-identified form which helps the Organization further understand how you collectively use the App or the Website.

4.3.  The Organization may collect your PII and SPII, for purposes such as, identification, registration, account authentication, and contacting you with notifications or emails in relation to the Website and/or the App.

4.4.  The Organization strives to achieve secrecy and confidentiality of your Information as per industry standards and applicable law. The Organization vis-à-vis its internal audits and checks, makes best efforts to ensure that there is no unauthorized monitoring or collection of Information.

4.5.  You understand, consent and agree that the Organization may use Information in order to improve marketing as well as promotional efforts which allows the Organization to analyze the App and/or Website usage, improve its content, product offerings and understand your preferences and to enhance, personalize, and customize your experience using the App and/or the Website. If you choose not to have your PII used for our weekly newsletter or other notifications related to the Website and/or the App, please click on the unsubscribe link accompanying such communication or write to privacy@itihaasa.com, and the Organization will respect your choice.

4.6.  You understand, consent and agree that the Organization may transfer Information to other parts of India or to other countries subject to applicable data privacy laws in a particular country, for the purpose of carrying on various transactions on the App and/or the Website. In doing so, the Organization shall ensure that the body corporate or the person to whom such Information is being transferred ensures the same level of data protection as provided under Indian data protection laws.

4.7.  The Organization along with its authorised employees, consultants and associates work closely with third parties engaged by the Organization. It is important that you understand that this Privacy Policy shall allow the Organization to use and disclose all your Information, whenever necessary to such authorised employees, consultants, associates and third parties engaged by the Organization. However, such third parties are bound to keep information they receive from the Organization confidential and protect it as per industry standards and applicable law.

4.8.  You understand and consent that in order to troubleshoot problems, or comply with applicable laws, judicial and regulatory orders and/or other related issues, the Organization shall use your Information and any other information that it may acquire from your activities on the App and/or the Website.

4.9.  You understand that while your account is active to use the App or the Website, the Organization shall retain your Information and use it any manner in accordance with this Privacy Policy or as required to comply with its legal obligations.

4.10. You undertake to ensure that all your PII is complete, accurate, and kept updated at all times. If there is any change in the PII, you shall promptly update your PII. If you provide any Information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or if the Organisation has reasonable grounds to suspect that such Information is untrue, inaccurate, not current or incomplete, the Organization has the right to suspend or terminate your account and refuse any and all current or future use of the Website and/or the App at its discretion, in addition to any right that the Organization may have against You at law or in equity, for any misrepresentation of information provided by You.

V.  Information Sharing

5.1.  The existing regulatory environment and applicable law makes it necessary for us to disclose your Information in ways not explicitly highlighted in this Privacy Policy. The Organization may disclose your Information in circumstances set out herein below:

5.2. Disclosure without Consent to Comply with Statutory/Legal obligations or Obligations in case of Emergency Situations.

5.2.1. We may need to disclose your Information without obtaining your consent in the following circumstances- (i) disclosure in relation to performance of any function of the government including any function that is necessary to provide any benefit to you (ii) disclosure to third parties such as law enforcement authorities, our legal representatives, courts of competent jurisdiction, judicial or administrative agency, or legislative body as and when it is deemed necessary to comply with law or regulation or order or judgment of any court/tribunal, (iii) to protect our rights, and (iv) disclosure to undertake prompt action such as attending to medical emergencies and medical treatment or health services (in situation of any epidemic, threat to public health) and to undertake safety measures in case of disruption of public order or natural disaster)

5.3. Subsidiaries or Affiliates

5.3.1. The Organization may share your Information with its subsidiaries or affiliates. However, the Organization shall ensure that such parties protect and safeguard such Information under their respective privacy policies.

5.4. Transfer of Business

5.4.1. The Organization may disclose or transfer your Information to any third party if we sell, transfer, divest, or disclose all or a portion of our business or assets to another company in connection with or during negotiation of any business transfer, merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding. Such third parties shall be contractually bound to not disclose further any Information disclosed to them. We shall, to the greatest extent possible, ensure that the third party is bound by all appropriate confidentiality obligations that the Organization is obligated to ensure under this Privacy Policy and you hereby provide your unequivocal consent to the same.

5.5. Third Parties

5.5.1. The Organization may use third parties in order to process your Information on their behalf. These third parties are obligated to keep your Information protected and confidential. The Organization does not share your Information with third parties unless doing so is necessary to carry out your request, or for the purposes of enhancing your experience of the Website and/or the App, or reasonably permissible under the laws to protect your Information. The Organization contractually requires such third parties to keep such Information confidential and use it only for the purposes for which the Organization discloses it to them. However, it is important to note that this Privacy Policy does not apply to the use or collection (directly by the third party) of your Information by any third party. Further, the Organization disclaims any liability or responsibility for any consequence arising out of, or in relation to the same. You consent and agree to the sharing of the Information including PII and NPII to third parties by the Organization. In the event your Information is directly collected by a third party without any intervention of the App or Website, you will be required to review the relevant privacy policy of such third party and provide your consent or decline to consent as per your own volition. It is clarified that the Organization shall not be liable whatsoever if certain features of the App are not available to you, if you fail or do not consent to the privacy policy of the third party.

VI. Security Precautions

6.1. The App or the Website has necessary reasonable security practices and measures in place which helps to reasonably protect loss, misuse, unauthorized access, disclosure, alteration, and destruction of the Information under the control of the App or the Website. Whenever you change or access your account Information, we offer the use of a secure server. Once your Information is in the possession of the Organization, the Organization adheres to necessary security guidelines and practices, for reasonably protecting it against unauthorized access or disclosure.

6.2. Your passwords will be kept protected. The Organization uses industry standards to ensure that protection of your passwords as collected by us (Organization will store your password only if you expressly consent to it). Only personnel authorised by the Organization will be given access where required to perform their job functions.

VII.  Suspension of Membership

7.1. The Organization will suspend your membership and delete your Information from its active databases upon request made by you via email at privacy@itihaasa.com. Such Information, if not deleted, will be de-identified (so that the data becomes anonymous and you cannot be identified) as soon as reasonably possible in accordance with its policies and applicable law.

7.2. However, the Organization shall retain your Information if such retention is explicitly mandated or necessary to comply with any obligations under any applicable law. The Organization conducts periodic review to check whether it is essential for the Organization to retain any of your PII in its possession.

VIII. External Links

8.1. You hereby understand and agree that when you use, install, access or visit the App or the Website, there may be certain links which may direct you to another website (the “Third Party Website”). The manner in which your Information is collected and/or used is governed by the terms and conditions and privacy policies of the respective Third Party Website. You hereby understand that the Organization has no control or responsibility over your Information in such an event as such Third Party Websites are not under the control of the Organization. The Organization urges you to acquaint yourself with policies of every such Third Party Website and in this regard the Organization expressly disclaims all liabilities with respect to the manner in which the Third Party Website collects and/or uses your Information.

IX. Grievances

9.1. If at any time, you have questions or concerns or grievances relating to or about the Privacy Policy, or grievances or discrepancies with regard to processing of Information in any manner please feel free to inform the Organization within 24 (twenty four) hours of occurrence of the instance from which the grievance has arisen, by writing an email to the Grievance Officer at privacy@itihaasa.com and we shall make best efforts to redress your grievance within 30 (thirty ) days, from the date of receipt of such grievance.
